We are BookWorld (Raamatukogu OÜ, established and existing under the laws of Republic of Estonia, registry code 14025647, address at Kesk-Sõjamäe Street 10a, Tallinn, Harju county 11415, Republic of Estonia), an Estonian company offering online private library service via website We provide a web-based platform where our users can share their books, thoughts and passion for reading with friends connected to their BookWorld profile.
If you are interested in our services we request you to accept this end user licence agreement (EULA). Please read this EULA carefully, as the terms of this EULA provide a legal basis for our relationship with you.
By clicking “accept” or by using BookWorld software or services, you agree to terms of this EULA. If you do not agree to the terms of this EULA, do not click “accept”, nor use our services.

    1. "EULA" means this end user licence agreement, including any amendments to this end user licence agreement from time to time;
    2. "Effective Date" means the date upon which the User gives the User's consent to this EULA;
    3. "Friends" means User’s contacts connected with User’s profile;
    4. "Force Majeure Event" means an event, or a series of related events, that is outside the reasonable control of the party affected (including failures of the internet or any public telecommunications network, hacker attacks, denial of service attacks, virus or other malicious software attacks or infections, power failures, industrial disputes affecting any third party, changes to the law, disasters, explosions, fires, floods, riots, terrorist attacks and wars);
    5. "Intellectual Property Rights" means all intellectual property rights wherever in the world, whether registrable or unregistrable, registered or unregistered, including any application or right of application for such rights (and these "intellectual property rights" include copyright and related rights, database rights, confidential information, trade secrets, know-how, business names, trade names, trade marks, service marks, passing off rights, unfair competition rights, patents, petty patents, utility models, semi-conductor topography rights and rights in designs);
    6. "Licensor" or “BookWorld” means Raamatukogu OÜ, a company duly incorporated in the Republic of Estonia, registry code 14025647, having its registered office at Kesk-Sõjamäe street 10a, Tallinn, Harju county 11415, Estonia;
    7. "Personal Data" means any personal data that you disclose to BookWorld, regardless of the form or format in which such data exists, including a person`s full name, e-mail address, location and geo-data;
    8. "Platform" means platform provided by Licensor via website;
    9. "Privacy Policy" means BookWorld privacy terms incorporated in this EULA;
    10. "Services" means any services or features that the Licensor makes available to the User, including through its website;
    11. "Software" means software provided by the Licensor via website;
    12. "Software Defect" means a defect, error or bug in the Software on the appearance, operation, functionality or performance of the Software, but excluding any defect, error or bug caused by or arising as a result of:
    13. "Source Code" means the Software code in human-readable form or any part of the Software code in human-readable form, including code compiled to create the Software or decompiled from the Software, but excluding interpreted code comprised in the Software;
    14. "Term" means the term of this EULA;
    15. "Update" or “Upgrade” means a hotfix, patch or version update or upgrade to the Software;
    16. "User" or “you” means the person to whom the Licensor grants a right to use the Software under this EULA;

  2. TERM
    1. This EULA shall come into force upon the Effective Date.
    2. This EULA shall continue in force until subject to termination in accordance with Clause 7.  
    1. For accessing the Platform and Services you shall register via Web Site and accept the EULA. You confirm that any registration information you submit is true, accurate, and complete. Details of the required registration information are provided on the Web Site. For avoidance of any doubt, you may not use the Platform or Services if you do not accept this EULA.
    2. Upon registration you will be asked to choose a password for your account. Keeping your password secure is paramount for protecting your personal information and avoiding violation of your rights. You agree not to share your account name and password with others or do anything that might jeopardize security of your account.
    1. Subject to this EULA, you are granted a limited non-exclusive license to use the Platform and Services. The Platform (including all features of the Platform) is solely and exclusively owned and operated by BookWorld. Intellectual Property Rights, including, but not limited to, any and all copyrights, trademarks, service marks and trade names contained in the Platform, are owned by BookWorld, its affiliates and/or BookWorld’s third-party licensors.
    2. You understand that your use of the Platform or Services does not grant to you ownership of any content of the Platform or Services.
    3. When using the Services and Platform, you are allowed to create lists of the books you have in your bookshelf, books you have lent out or lent in or books in your wishlist. You are allowed to share such information with Friends connected to your profile only for non-commercial use. Upon uploading any information about any book, including, but not limited to when uploading the cover pictures of the books, quotes, sections, any parts of the books (including when using OCR technology), opinions, etc., you shall follow all applicable laws and regulations, including all applicable copyright laws, and guarantee that you do not violate, at any time, any author’s rights or any other Intellectual Property Rights. For avoidance of doubt, you shall not upload any information protected with Intellectual Property Rights which override the legitimate interests of rights holders or harm rights holders in other way, nor use any part of the Platform or Services for any commercial purposes.
    4. Unless provided by applicable law, you shall not modify, translate, disassemble, decompile or re-engineer a part or the whole of Platform or Services. You shall not copy, distribute or publish any content of the Platform or Services or any information obtained or derived there from, unless provided by applicable law.
    5. It is prohibited to:
      1. use the Platform or Services for any unlawful purpose;
      2. use the Platform or Services for any business purpose;
      3. solicit others to perform or participate in any unlawful acts;
      4. violate any international or local regulations, rules and laws, especially copyright laws;
      5. harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
      6. submit any false or misleading information;
      7. upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services;
      8. spam, phish, pharm, pretext, spider, crawl, or scrape;
      9. use the Platform or Services for any obscene or immoral purpose;
      10. interfere with or circumvent the security features of Services or Web Site;
      11. circumvent any technical measures we use to provide the Services;
      12. upload or reproduce to the Platform works of architecture and landscape architecture, works of visual art of limited edition, electronic databases or notes in reprographic form.
      13. You understand and agree that upon your use of the Platform or Services, BookWorld does not provide you any maintenance or support services.
      14. BookWorld may, at any time, provide or make available Updates or Upgrades, including without limitation, bug fixes, service enhancements, new features, deletion of existing functions, or modifications. Updates and Upgrades will be governed this EULA, unless separate terms are provided. However, you understand and agree that making any updates or upgrades is sole discretion of BookWorld and BookWorld shall not, at any time, be obliged to provide any Updates or Upgrades.
      15. BookWorld reserves the right to update, change or replace any part of this EULA. Your continued use of the Platform or Services after posting of any changes constitutes acceptance of those.
      16. Nothing in this EULA shall give to you or any other person any right to access or use the Source Code or constitute any licence of the Source Code.
      17. Nothing in this EULA shall operate to assign or transfer any Intellectual Property Rights from the BookWorld to you.
    1. The Platform, Services and any content, or services or features made available in conjunction with or through the Platform or Services is provided “as is” and “as available” without any warranties of any kind either express or implied. To the fullest extent permissible pursuant to applicable law, BookWorld disclaims all warranties.
    2. BookWorld does not warrant or guarantee that the Platform or Services will be compatible with all or any hardware and software which you may use, available all the time or at any specific time, uninterrupted, secure or error free, suitable for your requirements or free from viruses, interference, hacking or other security intrusion.
    3. Including, but not limited to, BookWorld shall not be responsible for the following:
      1. any permanent or temporary interruption, discontinuance, suspension or other type of unavailability of the Platform or Services;
      2. any interruption or cessation of transmission to or from the Platform or Services;
      3. any bugs, viruses, Trojan horses or the like, which may be transmitted to or through the Platform or Services;
      4. any decision made or any action taken by you in reliance of the data or recommendations provided by us;
      5. deletion of, corruption of, or failure to store any content or data;
      6. any disclosure, loss or unauthorized use of the login credentials due to your failure to keep such credentials confidential;
      7. the incompatibility of technologies used for accessing the Platform and Services, for example if certain features, functions, parts or elements of the Services are designed for use on a personal computer or laptop and do not function on a mobile platform or a tablet.
    4. BookWorld is not liable for any violation of any laws of regulations by you or in front of any third persons.
    5. You agree to indemnify and keep BookWorld indemnified against any and all liabilities, damages, losses, costs and expenses (including legal expenses and amounts reasonably paid in settlement of legal claims) suffered or incurred by the BookWorld and arising directly or indirectly as a result of any breach by you of this EULA, including, but not limited to regarding any breach by you of any applicable copyright laws.
    6. BookWorld will not be liable to you in respect of any loss of profits or anticipated savings.
    7. BookWorld will not be liable to you in respect of any loss of revenue or income.
    8. BookWorld will not be liable to you in respect of any loss of business, contracts or opportunities.
    9. BookWorld will not be liable to you in respect of any loss or corruption of any data, database or software.
    10. BookWorld will not be liable to you in respect of any special, indirect or consequential loss or damage.
    11. BookWorld will not be liable to you in respect of Software Defect.​
    1. For the provision of Services, BookWorld needs to collect and process some Personal Data about you and your Friends. This section incorporates our Privacy Policy  
    2. BookWorld collects and processes only such data that is voluntarily submitted by you to BookWorld.
    3. Personal Data that BookWorld processes about you includes the following: your full name, e-mail, your country and area (including your postal code), your opinions and ratings about books, your Friends’ e-mail addresses.
    4. BookWorld uses Personal Data only for the purposes and to the extent that it is necessary for providing you with Services.
    5. BookWorld does not disclose Personal Data to any third parties, unless it is necessary to operate, maintain, enhance or provide features of the Services, to provide information that you request, to understand and analyse the usage trends and your preferences, to improve the Platform and the Services or to send communications.
    6. BookWorld retains the Personal Data collected from you during the term of this EULA or as long as it is necessary for ensuring the provision of Services to you. After this EULA with you is terminated, all Personal Data will be deleted.
    7. If you submit to BookWorld any Personal Data of your Friends (their e-mail addresses), you confirm that you have obtained all necessary consents from the persons whose Personal Data you submit to us. You shall be solely responsible for the compliance with the personal data processing requirements in front of the persons whose Personal Data is submitted to and processed by BookWorld. You hereby agree to indemnify BookWorld from any liability regarding the compliance with the personal data processing requirements.

    1. BookWorld may ordinarily terminate this EULA by giving you 30 days` prior written notice of termination.
    2. BookWorld may extraordinarily terminate this EULA immediately by giving written notice of termination to you if;  
      1. you commit any material breach of this EULA;
      2. you commit any breach of this EULA and fail to remedy such breach within the reasonable time determined by BookWorld.
    1. Upon the termination of this EULA, all of the provisions of this EULA shall cease to have effect, save that the following provisions of this EULA shall survive and continue to have effect: 5, 8, 9.
    2. The termination of this EULA shall not affect the accrued rights of either party.
    3. For the avoidance of doubt, the licences of the Software and Platform in this EULA shall terminate upon the termination of this EULA and, accordingly, you must immediately cease to use the Software and Platform upon the termination of this EULA.
  9. GENERAL  
    1. No breach of any provision of this EULA shall be waived except with the express written consent of the party not in breach.
    2. If any provision of this EULA is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions of this EULA will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant provision will be deemed to be deleted).
    3. We may amend this EULA unilaterally from time to time, based on good reason or other legal ground stipulated in this EULA or applicable law.
    4. User may not assign, transfer, charge, license or otherwise deal in or dispose of any contractual rights or obligations under this EULA without our prior written consent.
    5. This EULA is made for the benefit of the parties, and is not intended to benefit any third party or be enforceable by any third party. The rights of the parties to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to this EULA are not subject to the consent of any third party.
    6. This EULA shall constitute the entire agreement between the parties in relation to the subject matter of this EULA, and shall supersede all previous agreements, arrangements and understandings between the parties in respect of that subject matter.
    7. This EULA shall be governed by and construed in accordance with Estonia.
    8. The Harju County court in Estonia shall have exclusive jurisdiction to adjudicate any dispute arising under or in connection with this EULA, unless pursuant to imperative statutory law you have a right settle the dispute in the court of your residence.
    1. The Clause headings do not affect the interpretation of this EULA.
    2. In this EULA, general words shall not be given a restrictive interpretation by reason of being preceded or followed by words indicating a particular class of acts, matters or things.
